This Privacy Policy explains how Axicos Systems ("Axicos," "we," "us," or "our") collects, uses, discloses, and protects information when you use StatIntel™, RotoIntel™, RotoIntel™ GT-R1, or any other product or service built on our ARCOS™ (Asset Reliability & Cost Optimizing Simulator) platform, including our website (collectively, the "Services").

Axicos Systems is a sole proprietorship (Udyam Registration No. [UDYAM-MH-33-0823683]) operated by Bhargav Khaund, proprietor ("we," "us"). If Axicos is later incorporated as a separate legal entity, this Policy will be updated to reflect that entity as the data controller.

By using the Services, you agree to the collection and use of information as described in this Policy. If you do not agree, please do not use the Services.

1. Information We Collect

Account information. When you register for an account, we collect your name, email address, and a securely hashed version of your password. We never store your password in plain text.

Billing information. Subscription payments are processed by our payment partner, Razorpay. We do not collect or store your full card, UPI, or bank account details — Razorpay handles that directly and shares with us only what is needed to confirm and reconcile your payment (such as transaction ID, plan, amount, and status).

Project and simulation data. StatIntel, RotoIntel, and RotoIntel GT-R1 are decision-support tools, and the inputs you provide — asset parameters, cost assumptions, reliability data, project names, and the outputs those tools generate — are stored so you can save, revisit, and export your work. This data belongs to you (see our Terms of Service for details) and is used only to provide the Services back to you, unless you separately agree to something else.

Technical and usage data. We automatically collect limited technical information needed to operate the Services securely, including IP address, browser type, device information, timestamps, and log data related to requests made to our servers.

Cookies. We use a small number of first-party, strictly necessary cookies (for example, axicos_session, statintel_access, rotointel_access, and rotointel_gt_access) to keep you signed in and to authorize access between our products. These cookies are essential to the Services and are not used for advertising. We do not currently use third-party analytics or advertising trackers.

2. How We Use Information

We use the information above to:

create and maintain your account, and authenticate you across Axicos products;

provide, operate, and maintain the Services, including running the simulations and calculations you request;

process subscription payments and licensing fees, and send billing-related communications;

provide customer support and respond to your requests;

maintain the security and integrity of the Services, including detecting and preventing fraud or unauthorized access;

improve and develop the Services, including diagnosing technical issues; and

comply with applicable law and enforce our Terms of Service.

We do not sell your personal information, and we do not use your project or simulation data to train models or share it with other customers without your consent.

3. Legal Basis for Processing

Where applicable law requires a legal basis for processing (for example, under the EU/UK GDPR), we rely on: performance of a contract with you (providing the Services you signed up for), our legitimate interests (securing and improving the Services), your consent (where you provide it, such as for optional communications), and compliance with legal obligations (such as tax and accounting records).

4. How We Share Information

We do not sell or rent your personal information. We share information only with:

Razorpay, to process payments and subscription billing;

Google Cloud Platform, which hosts our infrastructure, databases, and application servers;

Our email delivery provider, to send transactional emails (such as account verification and billing notices); and

Law enforcement or regulators, where required by law, or to protect the rights, safety, or property of Axicos, our users, or the public.

Any such third party is permitted to use your information only as needed to provide services to us, and is bound by confidentiality and data protection obligations.

5. International Data Transfers

Our infrastructure runs on Google Cloud Platform, and your information may be stored and processed in a country other than the one in which you reside. Where required by applicable law, we take reasonable steps to ensure such transfers are subject to appropriate safeguards.

6. Data Retention

We retain your account information for as long as your account remains active. If you close your account, we will delete or anonymize your personal information within 90 days, except where we are required to retain certain records (such as billing records) for longer to comply with tax, accounting, or legal obligations. Project and simulation data is retained until you delete it or close your account, after which it is deleted on the same schedule.

7. Data Security

We use industry-standard measures to protect your information, including encryption of data in transit (HTTPS/TLS), salted password hashing, and access controls limiting who can view account and project data. No system is completely secure, and we cannot guarantee absolute security, but we work to continuously improve our safeguards.

8. Your Rights

Depending on where you live, you may have rights to access, correct, delete, or export your personal information, to object to or restrict certain processing, or to withdraw consent where processing is based on consent. This may include rights available to residents of the European Economic Area and United Kingdom (GDPR), California (CCPA/CPRA), and other jurisdictions with similar laws. 9. Organizational Accounts

StatIntel, RotoIntel, and RotoIntel GT-R1 are licensed to organizations, and individual accounts are typically provisioned by an employer or organization as part of that license rather than signed up for personally. If you access the Services this way, your organization may be able to view your account activity and project data, manage or revoke your access, and act as the primary point of contact for administrative matters. We treat the organization's designated administrator as authorized to manage accounts and data on the organization's behalf.

10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. We will post the updated Policy with a new "Last updated" date, and where changes are material, we will provide additional notice (such as by email or an in-product notice).

These Terms of Service ("Terms") govern your access to and use of StatIntel™, RotoIntel™, RotoIntel™GT-R1, and any other product or service built on the ARCOS™ (Asset Reliability & Cost Optimizing Simulator) platform, together with our website (collectively, the "Services"), provided by Bhargav Khaund, proprietor, trading as Axicos Systems (Udyam Registration No. [UDYAM-MH-33-0823683]) ("Axicos," "we," "us," or "our").

The Services are designed for use in a professional or business capacity — whether by an organization, through the personnel it authorizes, or by an individual operating their own business, practice, or consultancy (such as a sole proprietor, freelancer, or independent consultant) — rather than for personal, household, or consumer use. By creating an account or otherwise using the Services, you agree to be bound by these Terms. If you are accessing the Services on behalf of an organization (including as an employee, contractor, or other authorized user), you represent that you have authority to bind that organization, and "you" refers to both you and that organization. Where the Services are instead licensed directly to an individual acting in their own professional or business capacity, references in these Terms to "your organization" mean that individual.

1. The Services

Axicos provides asset reliability and cost optimization decision-support tools, including:

StatIntel™ — statistical reliability and cost analysis for static equipment assets.

RotoIntel™ — reliability and lifecycle optimization for rotating equipment assets.

RotoIntel™ GT-R1 — a version of RotoIntel licensed to organizations for High Energy Systems.

All products are built on our proprietary ARCOS platform. We may add, modify, or discontinue features of the Services at any time, and will provide reasonable notice of material changes affecting paid functionality.

2. Eligibility and Accounts

You must have the legal capacity to enter into a binding contract, and must either be acting within the scope of authority granted to you by your organization, or be licensing the Services directly in your own professional or business capacity, to use the Services. Individual user accounts are provisioned as part of an organization's subscription or license, or directly to an individual professional or business licensee, and are intended for use in that professional or business capacity, not for personal or household use. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate registration information and to notify us promptly of any unauthorized use of your account.

Your organization is responsible for the acts and omissions of its authorized users under these Terms, for managing who is granted access, and for promptly notifying us when a user's access should be revoked (for example, when they leave the organization).

3. Subscriptions and Licensing

StatIntel, RotoIntel, and RotoIntel GT-R1 are each licensed for use in a professional or business capacity — to organizations for use by their authorized personnel, or directly to individual professionals operating their own business or consultancy — on a subscription or term-license basis. Fees, billing cycles, permitted users, and available plans are set out on our website or in an applicable order form at the time of purchase, and may be denominated in USD or INR depending on your location. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. We will provide reasonable advance notice before any price increase takes effect for existing subscribers.

Where a signed license agreement or order form exists between Axicos and an organization for any of the Services (including RotoIntel GT-R1), that agreement governs to the extent it conflicts with these Terms; otherwise these Terms apply.

All payments are processed through our third-party payment processor, Razorpay. By subscribing or entering into a license, you authorize Razorpay to charge the applicable fees to your organization's chosen payment method. Your organization is responsible for any applicable taxes.

4. Free Trials and Promotions

If we offer a free trial or promotional pricing, additional terms may apply and will be disclosed at the time of the offer. We reserve the right to modify or discontinue trial offers at any time.

5. Cancellation and Refunds

You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period, and you will retain access until then. Except as required by applicable law, fees already paid are non-refundable, including for partial billing periods.

6. License Grant and Restrictions

Subject to your organization's compliance with these Terms and payment of applicable fees, Axicos grants your organization, and the personnel it authorizes (or, where the Services are licensed directly to you as an individual professional or business, you), a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your organization's (or your own) internal business purposes. The Services are not licensed for personal, household, or consumer use.

You agree not to: (a) reverse engineer, decompile, or attempt to derive the source code or underlying algorithms of the Services; (b) resell, sublicense, or provide access to the Services to third parties without our written consent; (c) use the Services to build a competing product; (d) circumvent usage limits, security controls, or authentication mechanisms; (e) probe, scan, or test the security of the Services without our prior written authorization; or (f) use the Services for any unlawful purpose.

7. Intellectual Property

Axicos and its licensors retain all right, title, and interest in and to the Services, including the ARCOS platform, all software, algorithms, models, designs, and the StatIntel™, RotoIntel™, RotoIntel™ GT-R1, and ARCOS™ trademarks. Nothing in these Terms transfers any ownership of our intellectual property to you.

As between you and Axicos, you retain ownership of the data, parameters, and content you input into the Services ("Customer Data"). You grant Axicos a limited license to host, process, and display Customer Data solely to provide the Services to you. We may use aggregated or de-identified data (from which you cannot reasonably be identified) to improve our products, but we will not sell your Customer Data or share it with other customers.

8. Third-Party Services

The Services rely on third-party providers, including Razorpay for payment processing and Google Cloud Platform for hosting. Your use of the Services is also subject to the applicable terms of these providers where relevant. We are not responsible for the acts or omissions of third-party providers, though we select them with reasonable care.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

StatIntel, RotoIntel, and RotoIntel GT-R1 are decision-support tools that provide statistical analysis, modeling, and simulation outputs based on the data and assumptions you provide. They do not constitute professional, financial, engineering, or investment advice, and outputs should be independently reviewed before being relied upon for operational, financial, or engineering decisions. Axicos is not responsible for decisions made, or actions taken, based on the output of the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXICOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

AXICOS'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO AXICOS IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold Axicos harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

12. Term and Termination

These Terms remain in effect while you use the Services. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if we discontinue the Services (with reasonable notice where practicable). You may terminate by cancelling your subscription and ceasing use of the Services. Upon termination, your right to access the Services ends, and we will handle your Customer Data as described in our Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in India.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date, and where changes are material, we will provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. General Provisions

Force majeure. Axicos is not liable for delays or failures caused by events beyond our reasonable control.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Entire agreement. These Terms, together with our Privacy Policy and any applicable license agreement or order form, constitute the entire agreement between you and Axicos regarding the Services.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
